Terms and conditions
§1. GENERAL PROVISIONS
1. The online store available at restomotive.eu is operated by RESTOMOTIVE SPÓŁKA Z OGRANICZONĄ ODPOWIEDZIALNOŚCIĄ, headquartered in Świdnik (21-040), ul. Marszałka Józefa Piłsudskiego 43, registered under NIP: 7123476465, REGON: 528831235, hereinafter referred to as the “Seller”.

3. These Terms and Conditions are addressed to Consumers and define the rules and procedure for concluding a Distance Sales Agreement with a Consumer via the Store.
4. The Terms and Conditions are made available free of charge via the Store, allowing users to read, download, save, and print them before concluding a contract.
§2. DEFINITIONS
1. Consumer – a natural person performing a legal act with an entrepreneur not directly related to their business or professional activity.
2. Entrepreneur with consumer rights – a natural person entering into a contract directly related to their business activity, if the nature of the contract indicates it is not of a professional character.
3. Seller – RESTOMOTIVE SPÓŁKA Z OGRANICZONĄ ODPOWIEDZIALNOŚCIĄ
4. Customer – any entity placing an order through the Store.
5. Store – the online store operated by the Seller at restomotive.eu
6. Sales Agreement – a product sales agreement concluded between the Customer and the Seller via the online Store.
7. Order – the Customer’s declaration of intent made via the Order Form aimed at concluding a Sales Agreement.
8. Product – a movable item available in the Store that is the subject of the Sales Agreement.
§3. PRODUCT INFORMATION
1. The subject of sale includes car and motorcycle parts produced by the Seller, including engine, body, and suspension components.
2. Products offered in the Store are sold as standalone collectible items. They have not been tested or certified as required by legally binding automotive part regulations and do not have road homologation.
3. The information about Products in the Store, especially descriptions, specifications, and prices, do not constitute a commercial offer under the Civil Code, but serve as an invitation to enter into an agreement.
4. Product prices are quoted in Polish zloty (PLN) and include VAT. Delivery costs are not included in the product price.
5. The Seller reserves the right to change product prices, run or cancel promotions. These changes do not apply to orders already placed.
§4. CONDITIONS FOR CONCLUDING A SALES AGREEMENT
1. Orders can be placed through the Store’s website 24/7, all year round.
2. To place an Order, the Customer must:
a) select a Product and quantity,
b) complete the Order Form,
c) choose a delivery method,
d) select a payment method,
e) confirm reading the Terms and Conditions,
f) click the “Order with payment obligation” button.
3. The order will be processed if correct and complete contact details are provided to allow delivery.
4. After placing an Order, the Customer will receive:
a) immediately – an email confirming receipt of the order,
b) then – an email from the Seller confirming the order has been accepted.
5. The Sales Agreement is considered concluded upon receipt of the confirmation email mentioned in point 4b.
§5. PAYMENTS
1. Available payment methods:
– Przelewy24
– BLIK
– Cash on delivery
– Traditional bank transfer
2. In case of advance payment:
a) The Customer must make the payment within 7 calendar days of concluding the Sales Agreement.
b) Order processing starts upon confirmation of successful payment.
3. In case of cash on delivery:
a) The Customer pays upon delivery.
b) Order processing starts immediately after the Sales Agreement is concluded.
4. The Seller issues a receipt or VAT invoice for each sale.
§6. DELIVERY
1. Product delivery is available within Poland.
2. Available delivery options:
– DPD Courier – 20 PLN
– InPost Courier – 20 PLN
– InPost Parcel Locker – 20 PLN
– Personal pickup – free (address: ul. Wrotkowska 2, 20-469 Lublin)
3. Order processing time:
– Order preparation: up to 48 hours from payment confirmation (for prepayment) or from agreement conclusion (for COD)
– Estimated delivery time: up to 48 hours from shipment
4. Customers must inspect the package in the presence of the courier. In case of damage, it is recommended to complete a damage report.
§7. COMPLAINTS AND RETURNS
1. The basis and scope of the Seller’s liability for defects are defined in the Civil Code of April 23, 1964.
2. The Customer has the right to withdraw from the Sales Agreement within 14 days without giving any reason.
3. The withdrawal period expires 14 days after the Customer or a third party (not the carrier) takes possession of the item.
4. To exercise the right of withdrawal, the Customer must inform the Seller with an explicit statement (e.g., letter or email).
5. Upon withdrawal, the Seller will refund all payments received from the Customer, including delivery costs (excluding additional costs for non-standard delivery methods), within 14 days of receiving the withdrawal notice.
6. Complaints may be submitted:

7. The complaint should include:
– Customer’s details
– Order number
– Description of the defect
– Customer’s demand
– Proof of purchase (e.g., invoice)
8. The Seller will respond to the complaint within 14 days.
9. The Customer will be informed of the decision via email or in writing.
§8. OUT-OF-COURT DISPUTE RESOLUTION
1. Details on out-of-court consumer dispute resolution methods are available from local consumer offices, consumer organizations, Trade Inspection branches, and the UOKiK website:

2. Consumers may:
a) request arbitration at a permanent consumer arbitration court,
b) request mediation with the provincial Trade Inspectorate,
c) receive free support from consumer ombudsmen or organizations tasked with consumer protection.
§9. PERSONAL DATA
1. The Seller is the controller of Customers’ personal data.
2. Data is processed for:
– Fulfilling the Sales Agreement
– Handling returns and complaints
– Marketing (with consent)
– Statistical analysis
– Enforcing claims
– Accounting and tax obligations

§10. INTELLECTUAL PROPERTY
1. All rights to the Store, including copyrights, domain, name, templates, and logos, belong to the Seller.
2. Copying, modifying, or unauthorized use of Store content is prohibited.
§11. FINAL PROVISIONS
1. In matters not covered by these Terms, applicable Polish law applies, particularly:
– The Civil Code
– The Act on Electronic Services
– The Consumer Rights Act
– GDPR
2. These Terms come into force on 07-01-2025.
3. The Seller reserves the right to amend the Terms. Changes will be announced at least 7 days in advance. Orders placed before changes are processed under previous Terms.
4. These Terms do not exclude or limit any rights granted to Consumers under applicable law.
